For the purposes of these Terms and Conditions:

• "Applicant" refers to individuals who undergo the AI call screening process.
• "Recruiter" refers to companies or individuals who use our Service to screen job applicants.
• "Service" refers to the AI call screening platform operated by IAMDAN.
• "User" refers to any individual accessing or using the Service, including both Applicants and Recruiters.
• "Subscription" refers to the recurring payment arrangement for Recruiters to access and use the Service.

3. Services Provided

IAMDAN offers an AI-powered call screening service designed to help Recruiters assess job Applicants. Our services include:

• Automated phone interviews with job applicants using AI technology
• Recording and analysis of interview responses
• Generation of interview transcripts and assessment reports
• Secure storage and management of application data
• Dashboard access for Recruiters to review and manage applications

4. User Responsibilities

By using our Service, you agree to:

For All Users:

• Provide accurate, current, and complete information as required
• Use the Service only for lawful purposes and in accordance with these Terms
• Not use the Service in any way that could damage, disable, overburden, or impair it
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service for any fraudulent or deceptive purposes

For Applicants:

• Participate in call screening interviews honestly
• Not use AI tools or have another person answer questions on your behalf
• Not record or redistribute any part of the screening call

For Recruiters:

• Use our Service in compliance with applicable labor and employment laws
• Obtain proper consent from applicants before initiating the screening process
• Maintain confidentiality of applicant data
• Not use our Service for discriminatory hiring practices
• Properly secure your account credentials

5. Account Registration and Security

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

6. Account Suspension and Termination

We may suspend or terminate your account at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

7. Payments and Subscription

Our Service operates on a subscription basis for Recruiters. By subscribing to our Service, you agree to the following:

• Subscription fees are charged on a recurring basis (monthly or annual) until canceled
• Payment processing is handled by Stripe, subject to their terms of service
• Subscription fees are non-refundable except where required by law
• We reserve the right to change subscription pricing with prior notice
• You may cancel your subscription at any time, effective at the end of the current billing period

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of IAMDAN and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and service marks may not be used in connection with any product or service without the prior written consent of IAMDAN.

9. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

We do not warrant that the results provided by our AI screening system will be accurate, reliable, or meet your specific requirements. The Service is designed to assist with the recruitment process, not to replace human judgment in hiring decisions.

We do not guarantee uninterrupted, secure, or error-free service and cannot be held responsible for any service interruptions or data loss.

10. Limitation of Liability

To the maximum extent permitted by law, IAMDAN shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

We are not responsible for any hiring decisions made based on the results of our AI screening system. The ultimate responsibility for hiring decisions rests with the Recruiter.

In no event shall our total liability to you for all damages exceed the amount paid by you, if any, for using our Service during the twelve (12) months immediately preceding the event giving rise to the liability.

11. Indemnification

You agree to defend, indemnify, and hold harmless IAMDAN and its licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in London, United Kingdom.
